1. Eligibility

NanoMarketCap is a cryptocurrency market data aggregation platform that provides:

• Real-time and historical market data for Nano (XNO) and other cryptocurrencies, sourced from CoinGecko
• Analytical tools including dominance charts, scarcity parity comparisons, and speculation calculators
• Access to third-party cryptocurrency swap services via an embedded Nanswap widget
• Educational content about Nano, the x402 protocol, and cryptocurrency in general
• A voluntary donation system to support ongoing development

4. Data Accuracy

Market data is sourced from CoinGecko and other third-party providers. While we strive for accuracy, we make no warranties or representations about the completeness, accuracy, reliability, or timeliness of any data displayed. Prices, market caps, volumes, and derived calculations (speculation, parity) may be delayed, inaccurate, or incomplete.

5. Third‑Party Services

The Service integrates third-party services including Nanswap (cryptocurrency swaps), CoinGecko (market data), and Nano network nodes. These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service. The Nanswap integration includes an affiliate referral identifier.

6. Donations

Donations are voluntary contributions made in Nano (XNO) cryptocurrency to support the development and maintenance of NanoMarketCap. By making a donation, you acknowledge that:

• Donations are entirely voluntary and do not grant any rights, privileges, or ownership
• Cryptocurrency transactions are irreversible — donations cannot be refunded
• We do not provide tax receipts or donation acknowledgments for tax purposes
• Stated donation goals and milestones are indicative and not contractually binding
• We make no guarantees about how donation funds will be allocated or spent

7. Partner & Sponsored Content

The Service may display paid partner promotions and sponsored content. Partner spotlights are clearly labeled as such. The presence of partner content does not constitute an endorsement, recommendation, or guarantee of any partner's products or services. Users should conduct their own due diligence.

8. Intellectual Property

The NanoMarketCap website design, original content, and code are the property of NanoMarketCap. Market data is provided by CoinGecko under their terms of use and attributed accordingly. Nano™ and XNO are associated with the Nano Foundation. All third-party trademarks remain the property of their respective owners.

9. Prohibited Use

You agree not to:

• Abuse, overload, or interfere with the Service or its infrastructure
• Scrape, crawl, or harvest data from the Service beyond normal use
• Circumvent rate limits or security measures
• Misrepresent your identity or affiliation
• Use the Service for any unlawful purpose

10. Limitation of Liability

To the maximum extent permitted by law, NanoMarketCap, its operators, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. This includes, without limitation, damages from reliance on data, calculations, or third-party services accessed through the Service.

11. Indemnification

You agree to indemnify and hold harmless NanoMarketCap and its operators from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Modification & Termination

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may update these Terms from time to time. Continued use after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of France. For EU consumers, mandatory consumer protection laws of your country of residence continue to apply.

14. Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, internet outages, blockchain network issues, third-party service disruptions, or government actions.

15. Severability

If any provision of these Terms is found invalid or unenforceable by a competent court, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Disclaimer, constitute the entire agreement between you and NanoMarketCap regarding the Service and supersede any prior agreements or understandings.

17. Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by the relevant party.
